Economic analysis of OHADA law: from practice to theory.
Project summary
In the almost 20 years of its existence, OHADA has established itself as a dynamic and expanding legal area. However, the relevance and effectiveness of OHADA law have been called into question in the light of a method of analysis drawn from Anglo-Saxon law: the economic analysis of law. This method is strongly criticized by many jurists in the civil law tradition, who consider it inappropriate. Ultimately, what can be said about the capacity of OHADA law to build a legal area that is attractive to investment and to foster the development of member states? This study aims to provide an objective analysis of OHADA law in the light of this method.
Patrick Juvet Lowe Gnintedem was awarded the prize for the best thesis in Business Law or African Community Law by ERSUMA (Ecole régionale supérieure de la magistrature) for 2012, for his thesis entitled “Droit des brevets et santé publique dans l’espace OAPI”, defended in January 2011 at the University of Dschang – Cameroon.
